- DEPOSIT: is the legal requirement for “Consideration of Trade”. The consideration can as simple as a pen if the Seller finds that acceptable. Not advised. The deposit is a good indicator of the strength of the Offer.
- Terms: Inclusions & Exclusions, Expressed warranties, Rentals etc.
- Conditions: May contain Financing, Home Inspection, Seller Undertakings by example or the Deal may contain none making the Offer a Firm Offer.
- Closing or Possession Date: The legal transfer of Title to the subject property to the Buyer upon receipt of funds and terms of the agreement.
- Pre-Printed Clauses in the Agreement of Purchase and Sale (Offer) Contains obligations by both the Seller and Buyer to perform either directly or by their respective appointed Lawyers.
